If you contact us because you want to exercise one of your rights (see point 7), we ask you to clearly indicate which right you want to exercise. Please be as specific as possible when exercising your rights.
In the context of marketing Advice, consultancy management (including organizing events) and organizing performance and training, Horse Tonic is also a processor of personal data. This is covered in the agreements between Horse Tonic and the controller(s). This is not part of the current policy.


What personal data do we process?
Depending on your capacity, we collect the following personal data:
From customers:

  • General identification data (such as name, salutation, title/position, address, mobile and/or telephone number, e – mail, assigned identification data);
  • Financial identification data (such as identification and bank account numbers);
  • Financial resources (such as assets) and solvency (based on public data);
  • Financial transactions (such as amounts that the person included in the file must pay and paid);
  • Compensations;
  • Professional activities (including nature of the activity, nature of the goods / services used or provided by the person included in the file, business relations);
  • Social contacts (in connection with referrals);
  • Use of media and means of communication;
  • Memberships (other than professional, political or trade union);
  • Agreements and agreements with Samuel Debussche EZ;
    All other personal data that customers lawfully make available to Samuel Debussche EZ;

Of prospects:

  • General identification data (such as name, salutation, title/position, address, mobile and/or telephone number, e – mail, assigned identification data);

If you provide us with personal data of a third party, such as your:

  • independent employees;
  • drivers;

  • customers;
  • suppliers;
    then you guarantee to Horse Tonic that:
  • these personal data have been lawfully obtained from the third party and have been lawfully provided to Horse Tonic;
  • you provide Horse Tonic with personal data that is up-to-date;
  • you have provided this person with relevant information about the existence and content of this policy.

Why do we process the personal data (purposes)?


The personal data are processed for the following purposes:
3.1. Execution of the agreement

 

  • The correct execution of the agreement;
  • Drawing up invoices and invoicing data;
  • Customer service: so that we can help you quickly in case of questions and / or problems;
  • Sending inquiries to you so that we can improve our services;
  • Conducting credit checks and investigating, preventing and countering fraud;

  • Preventing misuse or improper use of our services;
  • The retention of personal data as evidence or for the establishment of a legal claim;
  • The retention of personal data to register attendance at/participation in events.
    3.4. Compliance with legal obligations
    Compliance with legal obligations (e.g. in the context of anti-money laundering legislation and the fight against terrorism);
    You are not obliged to share your personal data with us, but if you do not provide the requested personal data, we may not be able to provide you with the desired services and/or products.
    Legal basis of the personal data?
    The processing of personal data under point 3.1 is based on the performance of the contract or, at the request of the data subject, to take measures for the conclusion of the contract.
    The processing of personal data under point 3.2 is based on the explicit consent of the data subject.

The processing of personal data under point 3.3 is based on the legitimate interest of our company (only and when the legitimate interest of our company outweighs the interest of the data subjects). The interests were further set out in point 3.3.
The processing of personal data under point 3.4 takes place in order to comply with legal obligations that rest on our company.
With whom do we share the personal data?
We do not provide any personal data to third parties, unless these parties are contractually linked to Horse Tonic or act on behalf or subcontracting of Horse Tonic.
Of course, we have made agreements with these parties regarding the protection of your personal data.
We also do not provide personal data to companies outside the European Economic Area, unless there is an adequacy decision, appropriate safeguards, binding corporate rules or transfers referred to in Article 49 (1) GDPR.
In the legally determined cases, we are obliged to communicate certain personal data to the well-defined authorities.
How long do we keep the personal data?
We only keep the personal data for as long as this is necessary for the exercise of the purposes set out above.
Since the retention period depends on the purpose, but also on the type of personal data, the retention periods vary.
What rights do you have?
7.1. Right of access, rectification or erasure
7.1.1. Inspect
You have the right to access your personal data. If you request this, we will provide you with a copy of the processed personal data.
7.1.2. Rectification
You have the right to have incorrect or incomplete personal data corrected.
7.1.3. Wissing

You have the right to ask Horse Tonic to delete your data in the cases specified in Article 17 (1) GDPR, such as if you withdraw your consent or if you object to processing for direct marketing.
In that case, Horse Tonic will delete your data without delay, unless Article 17 (3) GDPR applies. For example, Horse Tonic will not have to delete your personal data if this is necessary in the context of compliance with a legal obligation.
7.2. Right to restriction of processing concerning you
You have the right to have the processing restricted in the cases provided for in Article 19 (1), e.g.: if the accuracy of the personal data is disputed.
7.3. Right to data portability
You have the right to request the personal data that you have provided to Horse Tonic or to have it transferred to another company.
7.4. Right to withdraw consent
You have the right to withdraw your consent at any time.
The withdrawal of your consent does not affect the lawfulness of the processing based on the consent, prior to its withdrawal
7.5. Right to lodge a complaint with supervisory authority
If you do not agree with Horse Tonic’s position, if you have comments regarding the exercise of your rights, or if you believe that the processing of your personal data is not in accordance with the legislation, including the GDPR, you can submit a complaint to the Supervisory Authority (https://www.gegevensbeschermingsautoriteit.be/).
7.6. Right to object to processing
You always have the right to object to processing for the purpose of direct marketing. In practical terms, you can do this by indicating the “opt-out” in the emails, after which you will no longer receive direct marketing emails from us.
Of course, it is possible that we will contact you if necessary regarding the execution of the agreement.
In addition, you always have the right to object to processing based on Article 6 (1), (E) or (f) GDPR.
